Welcome to RoomWhiz ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our AI-powered interior design platform, including our website, web application, API services, and any related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

RoomWhiz provides AI-powered interior design services that allow users to:

• Upload images of rooms and receive AI-generated design transformations
• Access multiple design styles and room types
• Use our API for integration into third-party applications
• Create and manage API keys for programmatic access

Our Service uses artificial intelligence and machine learning technologies to generate design suggestions. Results are for inspiration and visualization purposes only.

To access certain features of our Service, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

You agree not to use the Service to:

• Upload illegal, harmful, offensive, or inappropriate content

If you use our API, additional terms apply:

• API keys are personal and non-transferable
• Usage is subject to rate limits and quotas based on your plan
• You must secure your API keys and not expose them publicly
• Commercial use requires appropriate subscription plans
• We may monitor API usage to prevent abuse
• Service availability is not guaranteed; downtime may occur

You retain ownership of images and content you upload. By using our Service, you grant us:

• A limited license to process your content for providing the Service
• The right to use anonymized and aggregated data to improve our AI models
• Permission to temporarily store your content for processing purposes

We do not claim ownership of your content and will not use it for any purpose beyond providing our Service unless explicitly authorized.

Paid services are billed according to your selected plan:

• Fees are charged in advance for subscription services
• API usage may incur per-request charges
• All fees are non-refundable unless required by law
• We reserve the right to change pricing with 30 days notice
• Failure to pay may result in service suspension

The Service and its original content, features, and functionality are owned by RoomWhiz and protected by intellectual property laws. This includes:

• Our AI models and algorithms
• Software, code, and technical infrastructure
• Design assets and generated content templates
• Trademarks, logos, and branding

Generated design outputs are provided for your use, but the underlying AI technology remains our property.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Service, you consent to the collection and use of information as described in our Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OR COMPLETENESS OF GENERATED DESIGNS
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY OR ABSENCE OF HARMFUL COMPONENTS

Generated designs are for inspiration only and should not replace professional architectural or design consultation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOMWHIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, or goodwill
• Service interruptions or security breaches
• Errors in generated content
• Third-party actions or content

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any violation of these Terms.

You may terminate your account at any time by contacting us. Upon termination:

• Your right to use the Service ceases immediately
• Your data may be deleted after a reasonable period
• Outstanding fees remain due and payable
• These Terms survive termination where applicable

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our website
• Sending email notifications to registered users
• Displaying in-app notifications

Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in San Francisco, California.
